NEW YORK CITY TRANSIT AUTHORITY – STATUTE OF LIMITATIONS

NEW YORK CITY TRANSIT AUTHORITY – STATUTE OF LIMITATIONS

Contact Chiropractic, P.C. v. New York City Tr. Authority, 2016 NY Slip Op 73043 http://www.courts.state.ny.us/courts/ad2/calendar/webcal/motions/2016/M211195.pdf

The Court of appeals will comment on whether a 6 year or 3 year Statute of Limitations applies to the NYCTA:

ORDERED that the motion is granted, and the following question is certified to the Court of Appeals: Was the decision and order of this Court dated January 20, 2016, which determined that an action to recover first-party no-fault benefits from a party which is self-insured is subject to a six-year statute of limitations, properly made?  Questions of law have arisen, which, in our opinion, ought to be reviewed by the Court of Appeals (see CPLR 5713).

This is the Appellate Term decision being reviewed: http://www.nycourts.gov/reporter/3dseries/2013/2013_23410.htm
